1. Seller identification
The website https://bellabio.co (the “Site”) is operated by BellaBio LLC, a company registered in Wyoming, USA, with registered address at 1619 Sheridan Way, Wyoming, USA, email hello@bellabio.net and phone +1 408-908-8375 (“BellaBio”).
2. Acceptance
These Terms and Conditions (the “Terms”) govern access to the Site and the purchase of products offered on it. By browsing the Site or placing an order, you (the “Buyer”) confirm that you have read, understood and accepted these Terms, the Personal Data Processing and Privacy Policy, the Shipping Policy and the Returns, Withdrawal and Payment Reversal Policy, which form an integral part of these Terms. If you do not agree, do not use the Site or place orders.
3. Research use only
ALL PRODUCTS OFFERED ON THIS SITE ARE SOLD EXCLUSIVELY AS RESEARCH MATERIALS FOR LABORATORY, IN VITRO AND ANALYTICAL USE. THEY ARE NOT FOR HUMAN OR VETERINARY USE.
- The products are not medicines, foods, dietary supplements, herbal products or cosmetics, and are not offered to diagnose, treat, cure, mitigate or prevent any disease or condition.
- It is prohibited to administer, inject, ingest, apply or otherwise introduce the products into humans or animals, or to resell or promote them for those purposes.
- The technical information and references to scientific literature on the Site are provided for researchers for informational purposes only. They do not constitute medical advice, usage or dosage recommendations, or claims about safety or efficacy in humans or animals.
- BellaBio does not provide medical advice or administration protocols. Any communication with our team is limited to product information, technical documentation and orders.
- BellaBio may refuse or cancel any order, with a full refund, where there are reasonable indications that the products will be used on humans or animals or for an unlawful purpose.
4. Buyer requirements
By placing an order, the Buyer represents and warrants that they:
- Are at least eighteen (18) years old and have full legal capacity to enter into contracts.
- Are a qualified researcher, or act on behalf of an institution, laboratory or company engaged in research, with the training, facilities and knowledge needed to handle, store and dispose of research chemicals safely.
- Will use the products only for legitimate research purposes and in compliance with all applicable laws and regulations.
- Have provided true, complete and up-to-date information in the order.
BellaBio may request additional information to verify these representations before shipping an order. If the Buyer does not provide it or the information is not satisfactory, BellaBio may cancel the order and refund the full amount paid.
5. Buyer responsibility
From delivery onward, the Buyer assumes full responsibility for the handling, storage, use and disposal of the products and for compliance with the rules that apply to their activity. To the extent permitted by law, the Buyer will hold BellaBio harmless from any claim, damage, penalty or expense arising from the use of the products in breach of these Terms, in particular their use on humans or animals.
6. Product information
BellaBio strives to keep product descriptions, specifications, presentations and images accurate. Images are illustrative. Batch analysis documentation (certificate of analysis, COA) will be available on each product page. Product availability is subject to stock.
7. Prices and taxes
All prices are in Colombian pesos (COP). Prices published on the Site are the final product price and no additional IVA is charged. Shipping, where applicable, will be added. The total amount payable, showing products and shipping, will be clearly displayed to the Buyer before they confirm payment.
BellaBio may change prices at any time; changes will not affect orders whose payment has already been confirmed. If, due to an obvious error, a product is published at a clearly incorrect price, BellaBio will inform the Buyer and offer the option to confirm the order at the correct price or cancel it with a full refund.
8. Ordering process
To purchase, the Buyer selects products, reviews the cart, enters shipping and billing details, accepts these Terms and makes payment. Once payment is approved, BellaBio will send an acknowledgment with the order summary to the registered email. The contract is formed upon payment approval, in accordance with Law 527 of 1999 and article 50 of Law 1480 of 2011. BellaBio will keep proof of the transaction and issue the corresponding electronic sales invoice.
9. Payment methods
Payments are made by credit or debit card through Stripe, a third-party payment processor. To complete payment, the Buyer is directed to a payment page hosted on the encantocakes.com domain, which is different from bellabio.co, where Stripe processes the card. BellaBio does not store full card details. Transactions may be subject to anti-fraud checks, and BellaBio may cancel orders whose payment is not approved or shows signs of fraud. Fees charged to the Buyer by their card issuer, for example for international transactions, are outside BellaBio’s control.
10. Shipping
Shipping is governed by the Shipping Policy. In summary: we deliver within Colombia in an estimated 3 to 4 business days, in discreet packaging. Shipping costs 45,000 COP and is free for orders whose product subtotal is 300,000 COP or more. Delivery will in no case exceed the thirty (30) calendar days set out in article 50 of Law 1480 of 2011.
11. Withdrawal, warranty and payment reversal
The rights of withdrawal (retracto), legal warranty and payment reversal are governed by Law 1480 of 2011 and our Returns, Withdrawal and Payment Reversal Policy.
12. Coupons and affiliate program
Coupons and discount codes are personal, cannot be combined unless stated otherwise, cannot be exchanged for cash and are subject to the conditions and validity period stated in each case. The discount will be reflected in the total before payment. Participation in the affiliate or distributor programs is governed by their own terms.
13. Limitation of liability
To the fullest extent permitted by law, and without prejudice to the non-waivable consumer rights under Law 1480 of 2011:
- BellaBio is not liable for damages arising from use of the products in breach of these Terms, in particular their use on humans or animals, or from improper handling, storage or disposal by the Buyer after delivery.
- BellaBio does not warrant that the products are suitable for any specific research purpose beyond the published specifications.
- BellaBio’s total liability to the Buyer for any claim relating to an order will not exceed the amount actually paid for that order, except in cases of willful misconduct or gross negligence, or where the law provides otherwise.
- BellaBio is not liable for delays or failures caused by force majeure or acts of God.
Nothing in these Terms limits the legal warranty or any other consumer rights that cannot be waived under the law.
14. Intellectual property
The Site’s content, including text, images, logos, trademarks and design, belongs to BellaBio or its licensors and is protected by intellectual property law. Reproduction or use without prior written permission is prohibited.
15. Personal data
The Processing of the Buyer’s personal data is governed by the Personal Data Processing and Privacy Policy, in accordance with Law 1581 of 2012.
16. Changes
BellaBio may change these Terms at any time. Changes apply from their publication on the Site and do not affect orders placed earlier.
17. Requests, complaints and claims
The Buyer may submit requests, complaints or claims to hello@bellabio.net or by phone at +1 408-908-8375. We will respond within the legal time limits. The Buyer may also contact the Superintendence of Industry and Commerce (www.sic.gov.co).
18. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of the Republic of Colombia or, at the consumer’s choice, to the Superintendence of Industry and Commerce acting in its judicial capacity, without prejudice to any alternative dispute resolution mechanisms agreed by the parties.
